1. Introduction & Acceptance of Terms
Welcome to ArrivalLink. These Terms of Service ("Terms") constitute a legally binding agreement between you and Party Plug LLC ("Company," "we," "us," or "our") governing your access to and use of the ArrivalLink platform, including our website, web application, mobile-optimized interfaces, and all related services (collectively, the "Service").
By creating an account, accessing, or using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.
2. Description of Service
ArrivalLink is a software-as-a-service (SaaS) platform designed for home service businesses. The Service provides:
- Real-time GPS tracking of field technicians during active service trips
- Customer-facing tracking pages with live location, estimated arrival time, and distance remaining
- SMS notifications to customers containing tracking links
- Customer rating and review collection for completed service visits
- Automated review routing to third-party review platforms (e.g., Google, Yelp, Facebook)
- Job scheduling and calendar management for service appointments
- Fleet management dashboard with live map view of all active technicians
- Driving behavior analytics including speed, braking, and acceleration data
- Team management tools including technician invitation, role assignment, and profile management
- Company branding customization for customer-facing pages
- Vehicle information tracking and photo management
3. Account Registration & Eligibility
To use the Service, you must register for an account. You must be at least 18 years of age and have the legal authority to enter into these Terms. If you are registering on behalf of a business entity, you represent and warrant that you have the authority to bind that entity to these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that we reasonably believe are being used in violation of these Terms.
There are two account types: Administrator accounts, which create and manage a company workspace, and Technician accounts, which are invited by an Administrator to join an existing company. Technician invite links expire after seven (7) days.
4. Free Trial
New company accounts are eligible for a seven (7) day free trial beginning on the date of account creation. During the trial period, you will have access to all features available under the Pro plan. No credit card or payment information is required to start a free trial.
At the end of the trial period, access to the administrative dashboard will be restricted until a paid subscription plan is selected. Your data will be retained for a reasonable period following trial expiration to allow you to subscribe and resume use of the Service. We reserve the right to modify or discontinue free trials at any time.
5. Subscription Plans & Billing
The Service is offered under tiered subscription plans, each with defined feature sets and usage limits (such as the number of technician accounts). Current plan details and pricing are available on our website and within the Service. Prices are quoted in U.S. dollars and are subject to change with reasonable advance notice.
Payment processing is handled by Stripe, Inc. ("Stripe"). By subscribing to a paid plan, you agree to Stripe's terms of service. We do not directly store your full credit card numbers or banking information. All financial data is processed and secured by Stripe in accordance with PCI-DSS standards.
Subscriptions renew automatically at the end of each billing cycle unless cancelled prior to the renewal date. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, and no partial refunds will be issued for unused portions of a billing cycle.
6. User Responsibilities & Acceptable Use
You agree that you will:
- Provide accurate, current, and complete information during registration and keep your account information up to date
- Use the Service only for lawful purposes and in compliance with all applicable local, state, and federal laws and regulations
- Obtain all necessary consents from your technicians before enabling GPS tracking of their locations through the Service
- Obtain appropriate consent from your customers before collecting their personal information (name, phone number, address) and sending them SMS messages through the Service
- Not use the Service to send unsolicited messages, spam, or communications in violation of applicable telecommunications laws
- Not attempt to reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service
- Not use the Service to harass, abuse, or harm any individual
- Not interfere with or disrupt the integrity or performance of the Service
- Not attempt to gain unauthorized access to the Service, other accounts, or any related systems or networks
7. Location Data & GPS Tracking
The Service collects real-time GPS location data from technician devices during active service trips. This data is used to provide live tracking, estimated arrival times, route visualization, and driving behavior analytics. Location data includes latitude, longitude, speed, and timestamps.
Mapping, geocoding, and route calculation features are powered by Mapbox. Use of location-based features is subject to Mapbox's terms of service.
As an Administrator, you acknowledge and agree that you are responsible for informing your technicians that their location will be tracked during active trips and for obtaining any required consents under applicable law. Location tracking occurs only during active trips initiated through the Service and ceases when the trip is marked as completed or cancelled.
Customer destination addresses and coordinates are stored as part of trip records. Company service locations are stored for map centering and operational purposes.
8. Customer Data Handling
When using the Service, you will input information about your customers, including their names, phone numbers, and service addresses ("Customer Data"). You retain ownership of all Customer Data you submit through the Service. We process Customer Data solely to provide the Service to you and will not sell Customer Data to third parties.
You represent and warrant that you have obtained all necessary consents from your customers to collect, store, and process their personal information through the Service, including consent to receive SMS messages containing tracking links. You are solely responsible for compliance with all applicable data protection and privacy laws relating to your collection and use of Customer Data.
9. SMS Communications
The Service enables you to send SMS messages to your customers containing tracking links for active service trips. You acknowledge and agree that:
- You will only send SMS messages to customers who have provided their prior consent to receive such communications
- You are responsible for compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and all other applicable federal, state, and local laws governing electronic communications
- SMS messages are sent at standard messaging rates for the recipient and we are not responsible for any carrier fees incurred by message recipients
- We reserve the right to limit or suspend SMS functionality if we detect misuse or potential legal violations
10. Intellectual Property
The Service, including its design, software, text, graphics, logos, icons, and all related intellectual property, is owned by the Company and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited license to use it as described herein.
You retain ownership of all content you upload to the Service, including company logos, technician photos, vehicle images, and company branding materials ("Your Content"). By uploading Your Content, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and transmit Your Content solely as necessary to provide the Service to you and your customers.
11. User-Generated Content
The Service allows end customers to submit ratings (on a 1 to 5 star scale) and optional text comments for completed service visits. These ratings and comments are associated with the technician who performed the service and are visible to the company Administrator.
Ratings and comments must not contain unlawful, defamatory, threatening, harassing, or otherwise objectionable content. We reserve the right, but are not obligated, to review, monitor, or remove user-generated content at our sole discretion.
The Service may, based on your configuration, prompt customers who leave positive ratings to also leave reviews on third-party platforms such as Google, Yelp, or Facebook. We are not responsible for the content of reviews submitted to third-party platforms or for the terms and policies of those platforms.
12. Third-Party Services & Links
The Service integrates with and may contain links to third-party services, websites, and platforms. These include, but are not limited to, payment processors, mapping services, and review platforms. Your use of any third-party service is subject to that service's own terms and privacy policies, and we are not responsible for the practices or content of any third-party service.
We do not endorse, warrant, or assume responsibility for any third-party product, service, or content. Any transactions or interactions you have with third parties found through the Service are solely between you and the third party.
13. Service Availability & Modifications
We strive to maintain reliable access to the Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
We reserve the right to modify, update, or discontinue any feature or aspect of the Service at any time, with or without notice. Significant changes to the Service or these Terms will be communicated through the Service or via email to the address associated with your account.
14. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will meet your requirements, operate without interruption, be secure, or be free of errors.
We do not guarantee the accuracy of GPS location data, estimated arrival times, route calculations, or any other data derived from third-party services. You acknowledge that real-time location data may be subject to delays, inaccuracies, or gaps due to device limitations, network conditions, or other factors.
15. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the Company, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of or inability to use the Service, regardless of the theory of liability.
Our total aggregate liability for all claims arising out of or related to these Terms or the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
16. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party, including your technicians or customers; (d) any Customer Data you process through the Service; or (e) your failure to obtain necessary consents for GPS tracking, SMS communications, or data collection.
17. Termination
You may terminate your account at any time by contacting us. We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including if we reasonably believe you have violated these Terms.
Upon termination, your right to use the Service ceases immediately. We may retain your data for a reasonable period as required by law or for legitimate business purposes. Sections of these Terms that by their nature should survive termination (including, without limitation, intellectual property, limitation of liability, indemnification, and governing law) shall survive.
18. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Clark County, Nevada.
Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us and providing a written description of the issue. We will attempt to resolve the dispute through good-faith negotiation within thirty (30) days.
19. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting the revised Terms to the Service with an updated "Last updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically. For material changes, we will make reasonable efforts to notify you via email or through the Service.
20. Severability
If any provision of these Terms is held to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
21. Entire Agreement
These Terms, together with any policies or guidelines referenced herein, constitute the entire agreement between you and the Company regarding the Service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.
